Nobody likes to think about or ponder on death especially their own and this is one of the reasons why so many people put off writing a will for as long as possible. This is not however an advisable attitude to take as the importance of having a will cannot be expressed enough. When a person does unfortunately pass away it is often their wish that their estate be passed down to their loved ones however if a will is not drafted then this may not happen. People are often misinformed that when they die their estate will be passed to their next of kin even without a will. This is definitely not the case as the laws relating to inheritance of an estate are often complicated when there is no will in place. When a person dies and there is no will in place it is known as intestacy and an administrator must be appointed in order to administer the estate. The processes in which an administrator must follow are often lengthy which can cause problems for beneficiaries. For example if a spouse is going to rely on part of the deceased's estate for income they may have financial problems whilst the administrator's processes are being carried out. Once the administrator has been appointed the estate can finally be divided between beneficiaries. This takes roughly six to nine months if you are lucky and there is always the chance that people will argue and oppose any decisions that are made. Things can become complicated as there is no proof that the decisions made by the administrator are what the deceased would have wanted and arguments often occur. The process of distributing assets is far longer when there is no will and this is the primary reason why a having a will is so important. If you want a guarantee that your estate will be divided in the way which makes you happiest then there is no real alternative than to write a will. Whilst thinking about your own demise is not something that is going to make you happy, knowing that your loved ones are taken care of when you are gone should. Most people agree that they have not written a will because "they haven't got round to it" which indicates that there needs to be more communication about the importance of writing one from the legal profession. Remember that you should always seek legal advice when writing a will in order to be one hundred percent sure that you are doing it correctly and that your estate will be divided exactly as you wish.
